Sobre pleito que este Convento de Tondo siguio contra el guardia de Bangcosey. 1683

This is a formal petition from Fray Gaspar de San Agustín, the general procurator for the province of the Philippines, regarding a dispute over the payment of five pesos monthly to the Convent of Tondo by Captain Francisco de Rivera, the chief guard for the area. The dispute arose from the opening of the Bangcosey estuary, which was claimed to be on land belonging to the convent, and the guards had historically paid this amount as part of a prior agreement made to help the convent cover construction costs for their church. San Agustín requests a formal acknowledgment of this agreement and the continuation of the payments, while Captain Rivera argues against the payment, claiming lack of title or justification for it from the convent's prior. The case involves testimonies from various witnesses, affirming long-standing practices and agreements regarding the payments made by the guards to the convent, which have been regarded as a customary obligation. The document includes several decrees and responses from officials, ultimately siding with the convent’s right to collect these payments based on the established practices and agreements reinforced through the testimonies presented. This text is in the volume with the title "Pertenece al Aparador dentro de la Pared. Caxn No 4. Missiones. Leg 2." Historical papers and documents concerned with the Spanish Missions in the Philippines and East Asia, Vol. II, in the 17th century. Continuation of the previous volume. "Folio 1-480 Collection of documents, c. 1650-1733, on land owned by the Augustinians in Luzon, including title-deeds, grants, donations, transfers, litigation over the same, and demarcation of boundaries, etc. Comprises over 500 leaves, but the numeration is very erratic and there are gaps, duplication, etc. Original vellum binding, lettered on the cover: “Pertenece al Aparador fuera de la Pared. Caxⁿ N° 9. Papeles de Tagalos. Legajo 4 y 5.” This codex forms a most valuable source for the study of the Augustinian land-holdings, and their administration of the Filipinos on their lands, in the period 1650-1730."
